Plant variety protection can be used to protect new breeds of plant species. The term is 25 years, in exceptional cases (e.g., for hops, potatoes, vines, and some tree species) even 30 years, counting from the day the protection was granted.

Scope of application:
Propagation of new breeds of crop and ornamental plant species.

Exclusions:
Any plant variety not listed in the Species Register appended to the German Plant Varieties Protection Act.

Prerequisites:
A given plant variety must be new, sufficiently homogenous, consistent, and distinctive, and must also have a title suitable for registration.
